Centre for Environmental Law & Policy (CEELAPO) specializes in environmental law advisories and policy formulation. The consultancy advises clients in the private industry or public govern-ment institutions to help them steer clear of possible fines, legal action or misguided transac-tions, while actively participating in development of international best practice in management and or exploitation of the environment.

Compliance

As governments become more and more environmental in their thinking, so does their legal framework. In the Kenya, businesses are covered by numerous pieces of legislation such as The Environmental Management and Coordination Act, the Factories Act, the Local Government Act, Public Health Act, etc. In the event that private or public sector entities are found to be in breach of these regulations, they may face severe civil or criminal actions. Our role is therefore to proactively determine whether the business or activity in question is in compliance with current legislation and advice you accordingly.

Environmental Policy development

We proactively consider and review the extant law and policy on environmental and:

make recommendations for enactment and or amendment of legislation; and

prepare policies for consideration and adoption.

Energy

We undertake feasibility studies for renewable energy projects. For example, we provide consultancies on installation of micro hydro generation scheme which pay for itself over the course of its operational life.

Green Claims

We have been engaged to provide empirical substantiation of green claims, such as eco labels, which often involve work on supply chain or embodied carbon. In this regard, our corporate clients interested in demonstrating their green economy policies routinely engage us to review their policies and actual practice in implementing green economy policies.

Environmental Impact Assessment

We undertake the assessment of the possible natural, social and economic impacts, whether positive or negative, that proposed project may have on the environment with a view of ensuring that decision makers consider the ensuing environmental impacts when deciding whether to proceed with a project.

Carbon Emissions Trading

Emissions trading is an important aspect of Carbon Managem ent. We are currently working on a Draft Cross Boarder Legislation for management and regulation of carbon emissions trading.

Green consulting

This is a new field in our practice that specializes in assisting home owners and businesses adjust to the Green economy. In this regard, we analyze several aspects of a business, and find ways that a particular business can become more environmentally friendly; we calculate the carbon footprint of a business and make suggestions for reducing or mediating that impact; we examine the energy use of a company, areas where heat or energy are wasted and recom-mend improvements thereon; we specialize in implementing recycling programs for the express purpose of lowering solid waste disposal costs, which in turn can have a direct increase in the business’ bottom line.

Environmental Management Systems (EMS)

We also develop and implement environmental management systems to help clients achieve such as ISO 14001 which are large complicated systems that are often not implemented using internal man/woman power. An EMS meeting the requirements of ISO 14001:2004 is a management tool enabling an organization of any size or type to:

  • identify and control the environmental impact of its activities, products or services, and to;
    improve its environmental performance continually; and to
  • implement a systematic approach to setting environmental objectives and targets, to achieving these and to demonstrating that they have been achieved.

Our professional team should be able to assist both our private and public sector clients in realizing world class EMSs.It is noteworthy that whereas ISO 14001:2004 is a tool that can be used to meet internal objec-tives such as: providing assurance to management that it is in control of the organizational processes and activities having an impact on the environment; and assure employees that they are working for an environmentally responsible organization, it may also be used to meet external objectives, vis-à-vis: a) providing assurance on environmental issues to external stakeholders – such as customers, the community and regulatory agencies;b) complying with environmental regulations as set by statute or public policy;c) supporting an organization’s claims and communication about its own environmental policies, plans and actions; and d) providing a framework for demonstrating conformity via suppliers’ declarations of conformity , assessment of conformity by an external stakeholder – such as a business client – and for certification of conformity by an independent certification body.
